TERMS AND CONDITIONS OF HIRE

 

(Please read the following Terms and Conditions carefully)

 

 

1. DEFINITIONS AND INTERPRETATION

 

1.1 In this agreement the following definitions apply unless the context requires otherwise:

 

‘Client’ shall be deemed to be the person who has organised the Hire and is responsible for the payment of the Hire.

 

‘Company’ shall mean Police Car Hire UK.

 

‘Driver’ shall mean the chauffeur of the Vehicle being either the Owner or any person so appointed by the Owner.

 

‘Hire’ shall mean the contract between the Owner and the Client for the hire of a Vehicle, incorporating these terms and conditions.

 

‘Owner’ shall mean the party that owns and supplies the Vehicle for the Hire. ‘Reservation’ shall be deemed to mean a Hire where a deposit has been paid to hold the date, but the full amount has yet to be paid.

 

‘Vehicle’ shall mean any form of transport including, but not limited to, car, truck, van, bike or bus supplied by the Owner to the Client.

 

2. APPLICATION OF TERMS

 

2.1 Subject to any variation under condition

 

2.2, the Hire shall be on these conditions to the exclusion of all other terms and conditions (including any terms or conditions which the Client purports to apply under any booking form, order, confirmation of order, specification or other document).

 

2.3 No terms or conditions endorsed on, delivered with or contained in the Client’s booking form, order, confirmation of order, specification or other document shall form part of the Hire simply as a result of such document being referred to in the Hire.

 

2.5 .Where a confirmed booking has been made with police car hire uk, which is cancelled less than 48 hours before the Hire Period is due to commence the Customer agrees to pay a cancellation fee equal to 50% of the Rental Charges agreed by the Parties.

 

2.6 If any such cancellation shall occur within 1 working day of the time agreed for the commencement of the hire or the supply the Supplier reserves the right to payment in full of all Rental Charges that would have been payable had such cancellation not occurred.

 

2.7 The Client shall ensure that the terms of its booking form and any applicable specification are complete and accurate.

 

2.8 Any quotation is given on the basis that no Reservation shall come into existence until the Company despatches a booking form to the Client and receives a completed booking form and payment from the Client. If the Company does not receive a completed booking form and payment from the Client when the invoice has been issued, the Company reserves the right to release the date requested by the Client to another party.

 

3. RESPONSIBILITY

 

3.1 Television and film work or any other event where a third party is required to drive the Vehicle, the Client shall be responsible for obtaining all appropriate insurances for the third party to drive the Vehicle and will be responsible for all damage caused while our vehicles are on set.

 

4. SAFETY

 

4.1 A strict no smoking policy is employed in all Vehicles. Failure to adhere to this policy will result in the Hire being terminated with immediate effect; furthermore there will be no refund. The cost of repair of damage to the Vehicle caused by a breach of the no smoking policy, including the cost of a valet, shall rest with the Client.

 

4.2 The commission of any illegal or unlawful act or omission by the Client shall result in the immediate termination of the Hire without compensation. In the event of the Client o failing to wear a seatbelt, where fitted, the Hire will be terminated without any refund, and furthermore the Client will indemnify the Owner and the Driver against any and all fines imposed as a consequence of the breach of the legal requirement.

 

4.3 Under no circumstances will the Driver carry more passengers in the Vehicle than is legally permitted.

 

4.4 Irresponsible behaviour on the part of the Client or other crew inside or outside of the Vehicle during the course of the Hire will not be tolerated. At the sole discretion of Driver the Hire may be immediately terminated without recompense. Furthermore the Client will be held responsible for any loss, howsoever caused, by his own irresponsible behaviour or that of any crew.

 

5. GENERAL CONDUCT

 

5.5 Should the Client hire the Vehicle for the purposes of a static display, the Client shall be responsible for providing all of the necessary security arrangements to protect the Vehicle and shall ensure that the Vehicle is roped off from all members of the public.

 

7. PAYMENT

 

7.1 Once we have received the completed booking form, our accounts department will send across the invoice.

7.2 Payment is to be made on receipt of the invoice, paid by BACs all details will be below on the invoice.

 

8. LIMITATION OF LIABILITY

 

8.1 It is the Company’s responsibility to ensure that there is adequate time to travel to the filming/event location.

 

8.2 The Company undertakes to use its best endeavours to ensure that the Vehicle booked is the one provided for the Hire. However, the Company reserves the right to alter the type of Vehicle at any time provided that such alteration is notified to the Client beforehand and the Client is given the opportunity to cancel the Hire.

 

9. ADDITIONAL CHARGES

 

9.1 If filming goes over the timings that have been given then the company has the right to charge extra.

 

9.2 The Client is responsible for letting us know by phone or Whats app and has to be agreed, to discuss payment.

 

9.3 Payment needs to be made prior to the extra time.

 

10. FORCE MAJEURE

 

11.1 The Owner reserves the right to defer the date of Hire or to cancel the Hire (without liability to the Client) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of the Owner including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers, provided that, if the event in question continues for a continuous period in excess of 30 days, the Client shall be entitled to give notice in writing to the Owner or Company to terminate the Hire.

 

12. DATA PROTECTION

 

12.1 The Clients’ personal details will be held and/or transferred in strict accordance with the applicable data protection laws. The Clients’ personal details will not be disclosed to any other company, and will only be used to keep the Clients updated with the Company’s services. Clients may, however, instruct the Company not to use their details for direct marketing purposes.
